Flashback API – Terms of Service

1. Acceptance of Terms

By accessing or using the Flashback API (“API”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, you must not use the API.

2. License Grant

Subject to these Terms, you are granted a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the API solely for your internal business purposes.

You may not:

• Resell, redistribute, or sublicense the API
• Expose the API through a competing service
• Use the API to build a substantially similar product

3. Authentication & Security

• Access is controlled via API keys or tokens
• You are responsible for safeguarding credentials
• You must not share or embed keys in publicly accessible code
• You must notify us immediately of any suspected compromise

We reserve the right to revoke or rotate credentials at any time.

4. Acceptable Use

You agree not to:

• Reverse engineer, decompile, or attempt to extract source logic
• Circumvent rate limits or access controls
• Use the API for unlawful, harmful, or abusive purposes
• Interfere with system integrity or performance

5. Rate Limiting & Fair Use

• API usage is subject to rate limits and quotas
• Limits may be enforced per key, IP, or account
• Excessive usage may result in throttling or temporary blocking

We reserve the right to modify limits at any time without notice.

6. Data Usage & Ownership

6.1 Customer Data

All data submitted to or generated from the customer’s systems, including time-series process data (“Customer Data”):

• Remains the sole and exclusive property of the customer
• Is provided to ALS Pty Ltd for the purpose of delivering the API and associated services
• Will not be sold, shared, or disclosed to third parties except as required to deliver the service or as required by law

6.2 ALS Platform & Derived Data

ALS Pty Ltd retains ownership of:

• The API, software, and underlying platform
• Any algorithms, models, or methodologies used to process data
• Aggregated or anonymised data that does not identify the customer, which may be used for system improvement, analytics, or benchmarking

6.3 Data Usage Rights

You grant ALS Pty Ltd a limited, non-exclusive right to:

• Store, process, and transmit Customer Data as required to operate the service
• Perform backups, replication, and transformations necessary for reliability and performance

6.4 Storage & Caching

Unless otherwise agreed in writing:

• API responses may be cached for operational use
• Long-term storage or replication outside the platform must not degrade system performance or violate agreed commercial terms

7. Commercial Terms

Where applicable:

• Usage may be billed based on requests, data volume, or subscription tier
• Overages may incur additional charges
• Failure to pay may result in suspension

8. Service Availability

• The API is provided on an “as is” and “as available” basis
• No guarantee of uptime, latency, or data completeness
• We may modify, suspend, or discontinue the API at any time

9. Monitoring & Enforcement

We may monitor usage to:

• Ensure compliance with these Terms
• Detect abuse or abnormal patterns

Violations may result in:

• Rate limiting
• Suspension
• Permanent termination

10. Termination

We may suspend or terminate access:

• At any time, with or without cause
• Immediately upon breach of these Terms

Upon termination:

• All rights granted to you cease immediately
• You must stop using the API

11. Limitation of Liability

To the maximum extent permitted by law:

• We are not liable for indirect, incidental, or consequential damages
• Total liability is limited to fees paid (if any) in the preceding 12 months

12. Disclaimer of Warranties

The API is provided without warranties of any kind, including:

• Fitness for a particular purpose
• Accuracy or reliability of data
• Continuous availability

13. Modifications

We may update these Terms at any time. Continued use of the API constitutes acceptance of updated Terms.

14. Governing Law

These Terms are governed by the laws of Western Australia, Australia.

A. Industrial / Operational Use Disclaimer

This API is not certified for safety-critical or real-time control systems. Use in operational technology (OT), SCADA, or process control environments is at your own risk.

B. Data Accuracy Note

Time-series data may include:

• Gaps
• Substituted values
• Delayed writes

Users are responsible for validation before operational use.
